Who is responsible for handling probate?

The responsibility for handling probate typically falls to the executor named in the deceased person’s will or to a personal representative appointed by the court if there is no will or if the named executor is unable or unwilling to serve. The executor or personal representative is responsible for managing the estate, including tasks such as gathering assets, paying debts and taxes, distributing assets to beneficiaries, and fulfilling other obligations outlined by probate laws and court orders. The executor or personal representative may work with attorneys, accountants, and other professionals to assist in the probate process.
