What Happens When You Inherit a Home in California?

Inheriting a home can be both a blessing and a challenge. Whether it’s your parents’ longtime residence or a relative’s investment property, the emotional and financial responsibilities that come with an inherited home can feel overwhelming — especially if the property must go through probate.

As a South Bay Realtor experienced in probate and estate sales, I’ve guided many families through this process step by step. Here’s what you need to know if you’ve recently inherited a property in California.

1️⃣ Determine How the Property Is Titled
The first step is understanding how the home was owned. If it was held in a living trust, the successor trustee can often transfer ownership without court involvement. If it was held solely in the deceased person’s name, the property will likely need to go through probate — a court-supervised process that validates the will and authorizes the sale or transfer of property. For joint ownership with right of survivorship, title usually passes automatically to the surviving owner.

2️⃣ Understand the Probate Process
In California, probate can take six months to over a year, depending on the court and complexity of the estate. During probate, the court appoints an executor or administrator. An attorney and probate real estate agent may be hired to handle the sale. Property is appraised, listed, marketed, and sold under court oversight (if required).

3️⃣ Decide Whether to Keep, Rent, or Sell
Once ownership is clear, the heirs can decide what to do with the property. Ask yourself: Can the family afford ongoing expenses like mortgage, taxes, and maintenance? Would renting the property make financial sense? Is selling the best way to settle debts or distribute funds fairly among heirs?

4️⃣ Prepare the Home for Sale
Many inherited homes need updates, repairs, or complete clean-outs. A probate specialist can help coordinate estate sales, repairs, and marketing to attract the right buyers.

5️⃣ Work with the Right Professionals
